According to research by the Credit Management Research Centre at Leeds University Business School, 40,000 companies will suffer a similar fate by the end of the year. In the midst of the recession, many suppliers and buyers of goods and services will therefore need to pay extra attention to the terms of contracts that they are entering into.

  • Trade marks as assets of a liquidation: The UK's Trade Marks Act 1994 (?TMA 1994?) states that a registered trade mark and a pending application are both items of personal property (TMA 1994 s.2(1), s.22 and s.27(1)). As a result a registered trade mark, or even just an application for a registered trade mark, can be included as assets of a company in liquidation.
